Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and CommitGraphics ("CommitGraphics," "we," "us"). By downloading or using the CommitGraphics app or website (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
The service
CommitGraphics generates sports commitment announcement graphics using artificial intelligence. Graphics are AI-generated and may occasionally contain imperfections, inaccuracies, or unexpected results; watermarked previews are free (subject to fair-use limits), so you can regenerate until you're happy before using a download. The Service is for personal, celebratory use.
Eligibility and age
The Service is intended for users 13 years of age or older. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided us information, contact us at support@commitgraphics.com and we will delete it.
Purchases and billing
CommitGraphics offers one-time, non-renewing purchases ("Packs") billed through your Apple ID at the price shown before purchase: the Commitment Pack (15 clean HD downloads) and the Team / Program Pack (50 clean HD downloads). Packs are consumable purchases — they are not subscriptions, nothing renews automatically, and there is no recurring billing and nothing to cancel. A download is used only when you save a clean (watermark-free) HD graphic; free watermarked previews, regenerations within fair-use limits, and exporting an already-unlocked graphic in additional formats do not use downloads. Downloads are tied to your device and Apple ID, do not expire, and are non-transferable. Free watermarked previews are subject to daily fair-use limits. Payments, billing, and refunds are handled by Apple under the App Store terms; we do not process payments and cannot issue App Store refunds.
Legacy subscriptions
If you purchased the former CommitGraphics Pro monthly subscription, it is no longer offered to new users, but your subscription continues to work — you keep clean HD downloads for as long as it remains active. It renews and can be cancelled through your Apple ID as before (iPhone Settings → Apple ID → Subscriptions). Once it lapses, you can continue with one-time Packs.
Your content and license
You keep ownership of the photos and details you provide ("Your Content") and of the graphics you generate. You grant us and our AI processing partner a limited, worldwide license to use, process, and transmit Your Content solely to create your graphic and operate the Service. You represent and warrant that you own or have all rights and permissions necessary to provide Your Content, and that you (or your parent/guardian, if under 18) consent to it being processed by AI to create your graphic. Do not upload photos of other people without their permission (or a parent/guardian's permission for a minor).
Acceptable use
Do not use CommitGraphics to create content that is misleading, defamatory, hateful, sexually explicit, harassing, infringing, or that impersonates or falsely depicts another person. Do not use the Service to violate anyone's privacy, publicity, or intellectual-property rights, or any law. We may refuse, remove, or limit content or access that we reasonably believe violates these Terms.
Intellectual property and trademarks
School names, logos, mascots, colors, and trademarks belong to their respective owners. CommitGraphics is not affiliated with, endorsed by, or sponsored by any school, league, or athletic organization. Graphics are fan-style celebration content generated at your direction, and you are responsible for how you use them. If you believe content generated through the Service infringes your intellectual property, send a notice with details to support@commitgraphics.com and we will review and act appropriately, including removal where warranted.
AI-generated content
Outputs are produced by automated AI systems and may be inaccurate, generic, or not to your expectations. Do not rely on outputs as factual. You are solely responsible for reviewing any graphic before you share or publish it.
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless CommitGraphics and its owner from any claims, damages, liabilities, and costs (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your infringement of any third party's rights (including intellectual-property, privacy, publicity, or likeness rights).
Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your requirements.
Limitation of liability
To the maximum extent permitted by law, CommitGraphics will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50.
Apple App Store
These Terms are between you and CommitGraphics only, not with Apple, and Apple is not responsible for the Service or its content. To the extent any of these Terms conflict with Apple's standard Licensed Application End User License Agreement, those Apple terms govern for the App Store version of the app. You acknowledge: (a) Apple has no obligation to provide maintenance or support for the app; (b) Apple is not responsible for any product warranties, whether express or implied; (c) Apple is not responsible for addressing any claims relating to the app (including product-liability, legal/regulatory, or consumer-protection claims); (d) in the event of any third-party claim that the app or your use of it infringes intellectual-property rights, CommitGraphics, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Sections that by their nature should survive (including Your Content, Intellectual Property, Indemnification, Disclaimers, Limitation of Liability, and Dispute Resolution) survive termination.
Governing law and dispute resolution
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@commitgraphics.com and attempt to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be settled by binding individual arbitration administered under the rules of a recognized arbitration provider in New Jersey, rather than in court, except that either party may bring an individual claim in small-claims court. You and CommitGraphics waive any right to a jury trial and to participate in a class action or class-wide arbitration. If the class-action waiver is found unenforceable, the remainder of this section still applies.
